RENTAL CONDITIONS
1. PAYMENT, DAMAGE DEPOSIT & CANCELLATION POLICIES AND SCHEDULES. To secure this booking, a payment of 100% of the total is due within 1 day of confirmation of intention to book.
2. REFUND POLICY. The guest agrees to the following:
? Guests must cancel at least 120 days before check-in to receive a full refund for all nights, minus a 10% processing fee.
? Guests must cancel at least 60 - 119 days before check-in to receive a 50% refund for all nights.
? If a guest cancels less than 60 days before check-in, you’ll be charged 100% for all nights.
We strongly recommend that you purchase your own travel insurance for your protection.
3. RULES & RESTRICTIONS. The guest agrees to the following:
? Quiet hours are between 9 PM and 9 AM
? This a no-smoking property
? No pets allowed
? Total number of occupants will not exceed the quoted number unless agreed upon.
4. GUEST RESPONSIBILITY AND LIABILITY POLICY. The Guest is responsible for their own travel/health insurance. Neither the Owner nor the Manager shall be held responsible in any way for accidental injury, death, or damage/loss to the personal effects of the Guest. If, due to circumstances beyond the Owner’s control, such as flood, fire, hurricane, or other damage, the Owner is unable to honor this agreement. The Damage Deposit and advanced payments shall be fully refunded provided said damage was not the fault of the Guest. The Guest is responsible for all damages excluding wear and tear, and including those which
exceed the deposit amount.
5. DAMAGE PROTECTION. Should you notice any damage/irregularities upon your arrival, it is the guest’s responsibility to contact the host within 24 hours and report those issues. If any damage occurs during the stay, the guest must also report such damage before the checkout date. The damage reported by the guest will be verified by an inspector within 48 hours of check-out and submitted via a claim to the accidental damage protection insurance
agency according to their Terms of Waiver. The guest also agrees to fill out any information the insurance company requests in good faith.
6. CHECK-IN. Check-in time at the property is 4 pm. In case of check-in time after business hours, refunds or discounts will not be provided. The guest agrees to follow check-in time procedures.
7. CHECK-OUT. Check-out time is at 11:00 am. Guest agrees that if he or she fails to vacate the property by 11:30 am (30 minutes of tolerance) on the check-out day, a fee equal to one day’s rent will be charged on the credit card on file. No refunds or discounts will be provided if checking out before 10 pm. Late check-out must be authorized in advance. A fee in the amount of half of the full nightly rate will be charged for authorized late check-outs.
8. PET POLICY - NO PETS ALLOWED. For the convenience of other guests and in an effort to help us provide the most sanitary accommodations available, pets are not permitted. In the event that guest(s) brings a pet, their credit card will be charged a non-refundable fee of $750.00 (Seven Hundred and Fifty U.S Dollars) per pet. In addition, the guest’s credit card on file will be charged for any stains or damage caused by the pet.
9. SMOKING. This property is 100% smoke-free. Absolutely no smoking is allowed in the house. In case of smoking in the house, there will be an additional non-refundable fee of $500.00 USD (Five Hundred U.S Dollars) charged on the credit card on file.
10. TRASH/TRASH REMOVAL. You will be expected to empty full trash bins and dispose of garbage bags in the appropriate compactor (varies per city and community). There will be an additional $100.00 USD (One Hundred U.S Dollars) fee per bin charged for an excessive amount of trash left in the house. All garbage MUST BE placed into plastic bags (you may use grocery ones). If garbage was left without bags an extra fee $100.00 USD (One Hundred U.S Dollars) will be charged to clean each bin. For recycling (when available) follow bin instructions.
11. AIR CONDITIONING. Guest agrees not to set the temperature lower than 70 F or above 80F degrees. When the AC is being used, we request that all windows and doors be closed to reduce humidity and save energy.
12. SECURITY/ EMERGENCY. In case of life-threatening situations please call 911. Guest is aware that we have an emergency email to contact us after business hours. For your safety, please make sure to keep all windows and doors closed and locked all the time. Landlord and Property Manager are not responsible for damages, lost or stolen personal or property items. It is the guest’s responsibility to properly secure the house when leaving the property.
The Property Manager always reserves the right to have access to the property during guest stay. When needed, we always inform our guests of the name of the person who will contact them, such as: plumber, handyman, cleaning crew, etc. If any unauthorized person tries to contact you, please call us immediately. Do not give access to any unauthorized person to the house.
13. EXTRA GUESTS. Guest is aware of the limit of guests allowed in/on the property during the rented period. In case of additional guest(s), a daily fee of $50.00 USD (Fifty U.S. Dollars) plus taxes per person will be charged. Guest must inform us about the total number of guests staying in the property.
14. PARTIES. Absolutely any kind of party is NOT ALLOWED inside the property. If the guest has a party, an additional non-refundable fee of $1500.00 USD (One thousand Five Hundred U.S Dollars) will be charged to the credit card on file.
15. INTERNET. Complimentary Wi-Fi internet service is available at all properties. Please be advised that the service provided is not under our direct control. In the event of any service interruptions or slowdowns, we cannot be held responsible for any inconvenience caused. However, rest assured that our team will promptly inform the service provider and ensure that appropriate actions are taken to address any potential issues.
16.BBQ Usage and Gas Tank Policy. The BBQ is provided with one (1) full gas tank. If the gas tank runs empty during use, please ensure it is refilled at the nearest gas station at your own expense.
17. SANITARY SYSTEM. FLUSH ONLY TOILET TISSUE! Please do not flush any Personal Hygiene Products, Baby Wipes, Diapers, Nappies, Kleenex Tissues, Plastics, Paper Wrappers, etc. Anything other than toilet tissue can block the pipes and these blocks can very easily cause toilets to overflow. In the event that the toilet does overflow, there is a stop valve behind and below the toilet. Please turn the water off and keep it off until the block is released. If you are unable to do so yourself, and wish for one of our maintenance staff to be called to unblock it for you, please remember that the cost of this service is typically $120.00
USD (One hundred and twenty U.S Dollars) and this amount will be charged against your security deposit.
18. APPLIANCES.
a. Dishwasher: Please use only dishwasher soap made specifically for dishwashers and NOT dish soap (washing-up liquid), which damages the machine. If non-dishwasher soap is used, the cost of repair is approximately $120.00 which will be deducted from your security deposit.
b. Clothes Washer: Follow machine instructions to put soap and softener liquid into the correct places.
c. Clothes Dryer: PLEASE CLEAN THE FILTER IN THE DRYER AFTER EVERY USE. Fluff builds up on the filter very quickly and if the filter is not cleaned the dryer could fail and/or catch fire.
It’s very important to never leave appliances, especially those that use gas or electricity, on when you're not around. This applies to BBQ grills, stoves, ovens, or any appliances that could pose a safety risk if left unattended.
19. WASTE DISPOSAL. The waste disposal unit is built into the sink and operated by a nearby switch on the wall. Use it to dispose of organic materials only, i.e. vegetable peelings, eggshells and leftover foodstuffs. No metal or bones should be put into the waste disposal. If something lock disposal additional charge of $120.00 USD (One hundred and twenty U.S. Dollars) will be charged. If the disposal HAS TO be replaced $500.00 USD (Five Hundred U.S Dollars) will be charged. REMEMBER ALWAYS RUN THE WATER WHEN USING THE DISPOSAL OR THE MOTOR WILL BURN OUT. TURN THE WATER OFF AFTER THE DISPOSAL HAS STOPPED.
20. FURNITURE. If, during your stay, you find it necessary to reposition furniture in the home then please do so with extreme care and reinstate everything to its original location before your departure. Any damage resulting from the moving of furniture will be charged to you. If we have to move the furniture back after your departure, we will charge the cost to you as it entails sending staff specifically to the property to undertake this task.
21. LOST & FOUND. We will not be held responsible for any items left at the property from the guest (s). As a courtesy, we will notify guest by email about the item found in the property and hold it for up to 30 days (thirty consecutive days) for guest to pick up at our location or have it delivered to guest address choice for a service fee of $20.00 plus the mailing costs. If items are left for 30 days or more unclaimed, Guest agrees that the Property Manager has the right to donate the item. If Guest requests a third party to pick up the item, Guest must send a writing authorization with the full name of the person who it will be picking up the item.
22. POOL & SPA - NO LIFEGUARD ON DUTY, SWIM AT YOUR OWN RISK. The pool and spa are available for your enjoyment; however, please note that there is no lifeguard on duty, and you swim at your own risk. For your safety, running or horseplay in the pool and deck area is strictly prohibited, as it may result in serious injury. Guests are also not permitted to tamper with the pool or equipment. While we do our best to ensure everything is in working order, we do not have control over any issues with the pool.
23. INSECTS. Florida is notorious for its prolific insect life and for that reason the Town homes are treated both inside and out. Ants are the most prevalent and annoying pests – they feed on a variety of foods such as sugars, syrups, jelly, grease, crackers, cookies and meats. Therefore, to make your stay more comfortable, please do not leave food or drinks on the
countertops, in wastebaskets and especially on the pool deck. You will want to avoid leaving dirty or damp clothes around because this is a favorite hiding place for insects and lizards. Please do not leave the windows and doors open. This increases insect infestation.
24. ATTORNEY’S FEES. If LANDLORD employs an attorney due to Guest’s violation of the terms and conditions of this agreement, GUEST shall be responsible for all costs and reasonable attorney’s fees as incurred by the landlord whether or not suit is filed. LANDLORD and GUEST waive the right to demand a jury trial concerning any litigation between LANDLORD and GUEST.
25. ARBITRATION AGREEMENT. Any controversy or claim arising out of or relating to this contract, or the breach thereof, shall be settled by arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association, and judgement upon
the award by the Arbitrator(s) may be entered in any court having jurisdiction thereof. Guests agree that the rent of the property is as a transient accommodation (short-term rental) in accordance with Chapter 509, and other applicable laws governing public lodging establishments. By signing here below, the Guest and Owner agree to all the terms and conditions in this rental agreement.
