GUEST agrees to abide by all rules and regulations contained herein or posted on the premises related to the Rental Property. GUEST’S obligations include but are not limited to keeping the premises as clean and safe as the conditions of the premises permit and causing no unsafe or unsanitary conditions in the common area and remainder of the premises that GUEST uses. GUEST agree not to use the premises for any commercial activities or purpose that violates any criminal law or governmental regulation. GUEST’S breach of any duty contained in this paragraph shall be considered material and shall result in the termination of guest occupancy with no refund of any kind. In no event shall the Rental Property be occupied by more persons than the capacity of the property as stated on the web site or the confirmation letter, without prior approval by OWNER. No fraternities, school, civic, or other non-family groups are allowed unless Owner grants prior approval. In no event shall GUEST assign or sublet the Rental Property in whole or in part. Violations of these rules are grounds for expedited eviction with no refund of any kind. GUEST hereby acknowledge and grant specific permission to Owner to enter premises at any time for inspection purposes should Owner reasonably believe that Guest are causing or have caused any damage to Rental Property. GUEST further agrees to grant OWNER access to Rental Property for purposes of maintenance and repair. If listed "For Sale", GUEST agrees to grant access by scheduled appointment upon notification. In the event GUEST wishes to terminate this agreement, Travel Insurance, Damage Protection and any processing or administrative fees are non-refundable. The cancellation and refund policy is as follows:
• 100% refund of all monies paid for cancellations 60 days or more before check in date.
• 50% refund of all monies paid for cancellations between 30 and 60 days before check-in - if paid according to the payment plan.
• No refund for Cancellations 30 days or less prior to check in date.
Including: Orders (national, international, local) made by authorities or Governments due to a pandemic, Hurricane or any other orders. Shortened stays due to late arrival or early departure or transportation cancellations and disruptions – no matter for what reason - and any other GUEST’S personal reason, Weather or beach conditions including Red Tide. Disruption of internet or energy services caused by anything out of control of the owner. Destruction of house which doesn’t allow check in anymore or damage to landscape and / or pool caused by weather including Hurricanes during the storm season June 1st to Nov. 30th NO REFUNDS will be given from monies which have been paid or for providing lodging for any day(s) the authorities order a mandatory evacuation order for in a "Tropical Storm/Hurricane Warning”. NO REFUNDS for any unused portion of rent from a guest currently staying, any unused portion of rent from a guest that is scheduled to arrive and wants to shorten the stay or to come in after the “Warning” is lifted and any advance rents collected for a reservation that is scheduled to arrive during the “Warning” period. NO REFUNDS for any unused portion of rent from a guest who had to leave the house due to an evacuation mandate or due to their own decision to leave the house and want to come back after the weather-related situation (including red tide) has improved and guest cannot check in anymore or does not like to check in anymore because the house / pool / landscape was damaged or internet or power services are interrupted.
There may be other circumstances besides weather related incidents in which the property is not available for GUEST’S check in anymore and OWNER decides to cancel. Then OWNER will refund 100% of all monies paid. If OWNER cancels after GUEST‘S check in, the unused portion of rent will be refunded. This will be the full extent of OWNER'S liability to GUEST in such circumstances and OWNER will not be responsible for any other costs connected with any such cancellation, howsoever arising.
GUEST must cancel by 11:59pm on the cut-off day before check-in to receive a refund. All times are specific to property's time zone. If GUEST doesn’t pay according to the payment plan, booking will be cancelled and GUEST will forfeit what they have already paid

We are encouraging all guests to purchase ‘For Any Reason’ trip insurance at time of booking for unforeseen travel issues. This includes fear of travel or simply changing your mind.
A payment of 25% is taken by OWNER at the time of the booking. Any remaining balance must be paid 61 days prior to the arrival date, or this Agreement may be cancelled by the sole option of the OWNER. An automatic credit card payment for the remaining balance will be scheduled by the OWNER to be made 61 days prior to the arrival date. The credit card of the first payment is used if a credit card was provided. If the automatic payment fails for any reason, it is the responsibility of the GUEST to make sure that the remaining balance is promptly paid in full, or the reservation will be canceled with no refund of payments made. All policies contained in this Agreement shall apply equally to payments made by credit card, check or cash and whether made via website, by phone or in person. Any refunds due to GUEST from a credit card payment will be refunded by credit card transaction; all other refunds will be made within 30 days by check.
A security deposit is required and will be automatically reserved for the booking. The automatic reserve is conducted by putting a hold or charge on the GUEST'S credit card for the amount of $500.00 exactly 3 days prior to the arrival date. The credit card of the last successful payment will be used. If there are no successful credit card payments, it is the responsibility of the GUEST to send $500.00 by check to the OWNER to satisfy the Security Deposit requirement. If, at the end of the rental period, the rental property is returned undamaged beyond normal wear and tear, the Security Deposit will be released in full within 7 business days. In the event of any damages, OWNER will provide GUEST with a full accounting of expenses incurred and deductions made from the Security Deposit. Should the damages exceed the amount of the Security Deposit, GUEST agrees to pay the balance within 7 business days after receiving notification. Deductions from Security Deposit may include, but are not limited to: Excess cleaning fee, trash removal fee, missing item replacement costs, damaged item replacement or repair costs, repair costs of buildings or grounds, House has been smoked in ($500.00), evidence for pets ($500.00 charge), Number of guests more than in contract, excessive water or power consumption (beyond 50% than average 3 months period before check in), excessive Water consumption caused by “running toilet” or similar misuse or other service call fees. Pipe Blockage: Toilets are checked before each check in. If a toilet or sink drainpipe was clogged after guests check in, guest has to cover the costs of $150.00 to clear the drainpipe. Guest is responsible for lost or damaged towels and linens at the cost of $45.00 each item. If any pet(s) found in or about the Rental Property will be grounds for expedited eviction and forfeiture of all monies paid. Owner is under no obligation to use the least expensive means of restoration. All amounts above + 13% tax.
Regular payments and security deposits for the booking will be displayed as SUNNYSIDE VACATION AMI on the GUEST'S credit card statement.
No refunds will be provided due to inoperable appliances, pools, Spa, clogged sinks or toilets, etc. The OWNER will make every reasonable effort to assure that such appliances will be and remain in good working order. No refunds will be given due to power blackouts, water shortage, flooding, construction at adjacent properties or mandatory evacuations of the area by county officials due to hurricanes or other potentially dangerous situations arising from acts of God or nature or in the event of a pandemic.
In the event OWNER is unable to make Rental Property available for any reason other than described above or a reasonable substitute as determined by OWNER, GUEST agrees that OWNER'S sole liability as a result of this unavailability is to provide a full refund of all monies paid under this Agreement and GUEST expressly acknowledges that in no event shall OWNER be held liable for any special or consequential damages which result from this unavailability.
Telephones in the Rental Property include calls in the US only - long distance telephone calls are not allowed.
GUEST is responsible for all shipping costs for any Lost and Found items that OWNER is requested to return to GUEST. Items found and not claimed within 30 days will be disposed of at the discretion of OWNER.
Pool/Spa Area Rules
Pool fence gates to pool deck area need to remain closed and locked when not in use- please check frequently.
Please shower and remove all sand prior to entering pool.
No glass is permitted in pool deck area.
Children under 12 need adult supervision at all times.
All non-toilet trained children must wear swim diapers at all times.
No pets, food, diving, or horseplay are allowed in pool.
Please be advised that pool area is slippery when wet so we discourage running in pool area.
Do not walk on rocks or in planting beds.
Swim and walk in pool area at your own risk.
The pool is heated for your comfort. Do not adjust settings on pool heater. Generally speaking, the Winter months are considered from November through April. During these months OWNER does his best to ensure that the pool is heated to a temperature of at least 82 degrees. However, please be aware that our area occasionally gets cold spells that can send the temperatures down into the 30's for a few nights in a row. This will cause the pool water temperature to drop down to in the 70's and a pool pump will automatically shut down if the outside temperature gets too cold-at day or night. The pump will then kick back on in the Morning (as long the temp. is not below 70) and begin re-heating of the pool back to 82, which may take several hours or days depending on the severity of the cold spell. Ultimately, these situations are beyond OWNER'S control. Due to the strict 10pm noise ordinance, the pool heaters will not run overnight. OWNER closely monitors the pool and it's temperature. Please allow weekly pool maintenance staff to perform duties while on site - usually each Thursday. Misuse of a pool by the spilling of foreign substances into the pool, i.e. soap, shampoo, oils, glass or metal will result in a Service Call Charge at the sole discretion of OWNER. Violation of this provision shall be grounds for expedited eviction and forfeiture of all monies paid.
Pool “Baby Fence” is provided for young children’s safety, we cannot be held responsible for any injury that occurs if they are tampered with or removed. It is GUEST'S responsibility to check before using the pool if it has been installed properly before using the pool area.
When using the Spa, remember there is a certain health risk associated with this facility. RULES: Use at your own risk. Do not put any foreign substance like soap in the water. A SPA is not a hot tub, it is simply a section of the heated pool that provides warm bubbles for comfort and relaxation but will not get hot (above 100 F). If you want to use the SPA you have to push the "SPA PARTY" Button and wait 40 to 45 Minutes until it is warm. During that time the pool will not be heated.
CHECK IN TIME: 3:30 PM EST CHECK OUT TIME: 10:30 AM. Unless prior written permission is granted by OWNER, late checkouts will entail a $1.00 + 13% tax charge for each additional minute.
The home has a maximum occupancy of six (6) guests. GUESTS who exceed the occupancy limit and falsify occupancy information at the time of reservation are subject to eviction and will be charged with US$500.00 per day per additional person (no matter what age) + 13% tax.
Checkout procedures: Any furniture (including beach furniture) moved during your stay must be placed in the original position. Upon checking out, please be sure that all windows and doors are closed and locked. All remotes must be placed in their holders. All trash must be placed in bags and taken outside to trash bins. All dirty dishes must be washed and put away. (Final day dishes should be run through the dishwasher-cleaners will turn it off). All linens can stay on beds.
Construction: In the event of neighboring construction in any street on the Island or on the beach, OWNER shall not be held responsible to provide any type of advance notification to incoming guests. No refund for such kind of reasons. Property views are subject to change due to construction that may occur anywhere on the island. Smoking: Smoking or vaping of any kind including is not permitted inside or outside or near any open windows or doors. This includes cigars, e-cigarettes, etc. Do not leave ashtrays or cigarette butts outside on the streets. Noise: Guests should not create excessive noise at a level that disturbs neighbors; Code-enforced neighborhood quiet hours are from 10:00p.m. – 7:00am. Police can issue tickets and fines and will notify us for violations in neighborhood areas. Any repeated reported violations of this can result in eviction. Parking: Designated parking is limited per house. Vehicles are to be parked in designated areas only. Parking on the road is NOT permitted. Any illegally parked cars are subject to towing; applicable fines/towing fees are the sole responsibility of the vehicle owner. Fire Safety: Only use appliances for their intended uses. Do not leave grills or stove/ovens unattended. Fire extinguisher is located downstairs next to entry door, in the garage and upstairs in the hallway. Do not tamper with smoke detectors. Hearing-impaired smoke detectors are available upon request. Please notify owner if you require one during your stay. Familiarize yourself and guests with emergency exits map provided on wall behind entry door. Garbage: Any garbage must be stowed in the proper garbage or recycling receptacle, located in front of the house. The City of Holmes Beach has strict regulations regarding trash. Trash pick-up is each Monday and Thursday – Recycling bins on Thursday. Do not pull bins to streets on any other day and bring them back in the garage when they have been emptied. Pests: Florida has lots of bugs. Please be advised the building and grounds are routinely treated for pests. While every effort is made to use non-toxic treatments, please use caution with children who crawl on ground. Follow recommendations regarding mosquito bite prevention. Grills/Propane: A Grill and one propane tank are provided as a courtesy for use by all guests. OWNER does his best to provide an extra filled tank. Let OWNER know if it is empty. City Ordinances: GUEST is responsible for familiarizing self and abiding by rules and instructions set forth in the ordinances in the city in which they are renting or visiting. House parties, Family Reunions, Weddings and other large gatherings or inviting more than 2 additional guests to use the house facilities AT DAYTIME are prohibited. NO overnight stays of additional guests. Illegal substances are strictly prohibited and grounds for immediate eviction. GUEST'S disturbance, annoyance, endanger or inconvenience of the neighbors are grounds for eviction. Pool hours are from 7:00am to 10pm – keep the noise below 50db from 10pm to 7am. OWNER may terminate this Agreement upon the breach of any of the terms hereof by GUEST. GUEST shall not be entitled to the return of any rental monies paid under the terms of this Agreement and shall vacate the Property immediately.
Agreement shall be enforced under the laws of the state Florida, including any applicable rental acts of Florida, and represents the entire Agreement. Any amendments must be here in writing. In the event of a dispute, legal action may only be instituted in Manatee County. If any part of this Agreement shall be deemed unenforceable by law, that part shall be omitted from this Agreement without affecting the remaining Agreement.
NOW, THEREFORE, in consideration of the mutual agreements and covenants herein contained, GUEST has read and agreed to the following:
I understand the rules and rental conditions upon which I am agreeing to rent accommodations, equipment, and use of the property. The property I rent will be returned in the same condition in which it was rented, and I will be responsible for all damage and/or loss that occurs during my rental period.
The Property is privately owned and I also agree to waive all possible claims for liability and damages against OWNER and OWNER'S agents, contractors, and related parties from and against liability for injury to me or any other person occupying Rental Property resulting from any cause whatsoever including, but not limited to, injury sustained as a result of use of the Furnishings, Fixtures, phone, spa, whirlpool tub, pool, exercise equipment, beach equipment, bikes, kayaks, pool and beach gear and toys etc. except only such a personal injury caused by the gross negligence or intentional acts of the OWNER. I promise to check at arrival if the pool “Baby Fence” is properly installed and notify OWNER immediately if it is not installed properly and keep the sliding doors to the lanai/pool area and fence gates always closed as long as it is not installed. I acknowledge and accept that the sole responsibility for safety lies with the participant. Owner is not responsible for the loss of personal belongings or valuables of any member of the Rental Party. I expressly understand that I bear sole responsibility for any accident, injury, death, illness or event of damage that might occur during the Lease Term. By signing this agreement, it is expressly understood that I, all members of the Rental Party, and any persons permitted on the Property by me during the Lease Term acknowledge and assume all risks of harm or injury arising from the occupancy of the Property or use of its Furnishings, Fixtures and Equipment. I agree to take full fiscal responsibility for any claim of liability or damages filed by any member of my Rental Party or any other person permitted on the Property during the Lease Term against OWNER, his agents, contractors, or related parties. In agreeing to this, I acknowledge that outdoor activities and exposure to the natural elements and animals can be dangerous and sometimes result in injury and even death. Steps and decks can be slippery, animals and insects can threaten and infect or injure, exposure to the elements can cause hypothermia, sunburn, among other risks inherent in participating in camping, outdoor and water activities. I know that alcohol and/or drugs do not mix safely with any outdoor activity. I am over the age of 25 and assume responsibility for those in my charge under the age of 25. I hereby assume all legal responsibility for bodily injury to me or to any person on the property as a result of my visit and use, operation or possession of equipment hired or loaned to me. Acknowledging this, I accept complete responsibility for the minor children and myself in my charge and visit the property and equipment and engage in activities or events at my own risk.
I will abide by the rules and accept these rental conditions.
I acknowledge receipt of the property in good order and condition (if found otherwise per my arrival I will contact Owner immediately by E-Mail:
[email protected]) and further agree that the Owner of the Rental Property shall not be liable for consequential damages of any kind or nature from whatever cause arising, whether property or equipment is loaned or rented.
I enter into agreement freely with the OWNER of the Rental Property at my own risk, acknowledging the risks inherent in indoor and outdoor activities and assume all responsibility for the minor children and myself in my charge.
All parties agree to and will comply with Federal, State and County pollution laws and any other applicable laws and regulations.
