Guests agree to the charges and acknowledge having read and understands the management policy on the following pages of this document.
Payment of the reservation deposit is considered acceptance of all terms regardless of the signature status of the contract. The guest is responsible for adhering to the rental terms and dates. Any error on the Guest’s part is not the responsibility of the Owner or his Agent.
MAXIMUM OCCUPANCY: The maximum number of guests is limited to 10 people. The reserving party must b 25 years of age or older and must occupy the rental for the entire duration of the reservation period. An adult over the age of 21 years is required to accompany all minors on the premises at all times.
SUBLEASING OF THE VACATION RENTAL IS STRICTLY PROHIBITED.
A refundable security deposit of $500 is required or Property Damage Protection must be purchased.
The guest will receive an individual entry code prior to arrival. Please ensure all doors and windows are closed and locked when you leave the property and upon departure. Guest maintains liability for non-secure windows, doors etc. for 24 hours after departure.
If you want to recharge golf carts etc., please use the outdoor, not the indoor outlets, so doors and windows will stay closed.
Any missing, lost or damaged items from the property shall be charged directly to the guest. The owner or his agent will make a courtesy call to discuss any charges beyond those agreed to on your reservation.
If police are called due to noise disturbances during your stay, guest will be responsible for any fines levied for the disturbance.
Open flames inside the property are prohibited.
Smoking inside the house is strictly prohibited.
We don’t allow pets on the premises. This includes visitors of guests.
No fraternities, school, civic, or other non-family groups are allowed unless Owner grants prior approval.
Guests hereby acknowledge and grant specific permission to Owner to enter premises at any time for inspection purposes should Owner reasonably believe that Guests are causing or have caused any damage to Rental Property. Guest further agrees to grant Owner access to Rental Property for purposes of maintenance and repair.
No refunds will be provided due to inoperable appliances, hot tubs, etc. The Owner will make every reasonable effort to assure that such appliances will be and remain in good working order. No refunds will be given due to power blackouts, water shortage, flooding, snow, construction at adjacent properties, or mandatory evacuations or lockdowns of the area by county officials due to hurricanes or other potentially dangerous situations arising from acts of God or nature. The booking does not include Travel Protection Insurance. Owner strongly suggests that Guest seeks Travel Protection also covering cancellations due to epidemiological reasons.
Guest is responsible for all shipping costs for any Lost and Found items that Owner is requested to return to Guest. Items found and not claimed within 30 days will be disposed of at the discretion of Owner.
HOT TUB
The guest hereby acknowledges that surrounding areas due to added amenities may provide additional dangers if guests are not careful. With full knowledge of the above facts, the undersigned accepts and assumes all risks involved in or around the amenities.
If a hot tub is provided at the Rental Property, it will be prepared and tested for proper and safe chemicals at least once weekly. Misuse of a hot tub or pool by the spilling of foreign substances into the pool, i.e. soap, shampoo, oils, glass or metal will result in a Service Call Charge at the sole discretion of Owner. Under no circumstances are pets allowed in pools or hot tubs. The pool and spa are for registered guests only. Violation of these provisions shall be grounds for expedited eviction and forfeiture of all monies paid.
GRILL
Please clean grill after use. We supply the propane upon arrival. There is a propane tank on the grill and a spare in the garage. If you run out during your stay, please purchase a refill.
AIR CONDITIONING
CANCELLATION
We do not offer refunds but will work with you to reschedule your dates up to 6 months. We do highly encourage our Guests to purchase Travelers Insurance. If you do cancel and we are able to rebook your dates we could offer a refund. There will be a $250.00 cancellation fee and any eligible refunds are subject to our ability to re-rent the accommodation at the price contracted. If the home is re-rented (partially or fully), we will issue a refund in the amount we were able to re-rent the property for, less the $250 cancellation fee. If there is a refund due; it will be issued after new renter has completed their reservation.
Eligible refunds will be determined based on the difference between the contracted amount and the re-rented price, less the $250 cancellation fee. There will be no refund if the home is not able to be re-rented. We do not make any sort of guarantee that we will be able to rent the property for what was paid originally.
No refunds will be given due to inclement weather or any other natural or manmade causes, failure to arrive or early departure for any reason. We strongly advise to purchase travel insurance that covers cancellations and the costs involved.
ARRIVAL
You will receive your door code by email about 48 hours before your arrival date. Check in time is at 4 PM.
DEPARTURE
• Check out time is at or prior to 10 AM on day of departure.
• Please remove all items from refrigerator.
• Please DO NOT REMOVE ANY BEDDING, SHEETS, COMFORTERS, MATTRESS PADS AND PROTECTORS OR PILLOW COVERS.
• Please put all towels by washer.
• Please load all dirty dishes and start the dishwasher.
• Please make sure grill is clean.
• Please take out all trash and lock all doors.
EVICTION ISSUES
Please remember we must adhere to the No Smoking, Pet, City Noise, Parking ordinances and Over Occupancy Rules which you have agreed to. Smoking in the unit, having an unauthorized pet, parking, noise violations, and more than ten guests residing in our rental property will result in immediate eviction with no refund. The reserving party must be 25 years of age or older and an adult over 21 must accompany any minors at all times.
TRAVEL PROTECTION
The booking does not include Travel Protection Insurance. We highly encourage all of our Guests to purchase Travelers Insurance.
DISCLAIMER
The owner takes zero responsibility for stolen personal items in the rare case of theft or vandalism.
RADON DISCLOSURE
Pursuant to §404.056(5), Florida Statutes, Radon is a naturally occurring radioactive gas that, when it has accumulated in a building in sufficient quantities, may present health risks to persons who are exposed to it over time. Levels of Radon that exceed Federal and State guidelines have been found in buildings in Florida. Additional information regarding Radon and Radon testing may be obtained from your public health office.
Legal Issues Guest agrees that any action arising out of, or relating to, this agreement shall be governed by Florida law and jurisdiction for any judicial proceeding concerning, or arising from this agreement, shall exclusively lie in Manatee County, Florida. Further, should any dispute, judicial or otherwise, arise concerning this agreement, the prevailing party shall be entitled to its attorney’s fees and costs. Prevailing party shall be determined by the presiding judge. The parties waive their right to a jury trial. Waiver of Liability and Damages: Guest, inclusive of minors who are family members of Guest, willingly accepts all risk of personal injury, health problems, death, and property damage which results from using and occupying the subject premises. Guest specifically waives all possible claims for liability and damages against the Owner of the subject premises and against his agent, arising from the Guest’s use of the subject premises. Safety precautions undertaken by the Owner are not foolproof, and Guest shall hold Owner harmless from all claims to person or property arising out of the use and occupancy of the premises. As to invitees of Guest, it agrees to indemnify and hold the Owner and his agent harmless from any claims made by the Guest’s invitees, arising from their use of the subject premises. In addition, Guest will take full fiscal responsibility if invitee does not indemnify and hold the Owner(s) or his agent harmless.
Owner may terminate this Agreement upon the breach of any of the terms hereof by Guest. Guest shall not be entitled to the return of any rental monies paid under the terms of this Agreement and shall vacate the Property immediately.
I understand the rules and rental conditions upon which I am agreeing to rent accommodations, equipment, and use of the property. I acknowledge and accept that the sole responsibility for safety lies with the participant. In agreeing to this, I acknowledge that outdoor activities and exposure to the natural elements and animals can be dangerous and sometimes result in injury and even death. Steps and decks can be slippery, animals and insects can threaten and infect or injure, exposure to the elements can cause hypothermia, sunburn, among other risks inherent in participating in camping, outdoor and water activities. I know that alcohol and/or drugs do not mix safely with any outdoor ac I am over the age of 25 and assume responsibility for those in my charge under the age of 18. I hereby assume all legal responsibility for bodily injury to me or to any person on the property as a result of my visit and use, operation or possession of equipment hired or loaned to me. Acknowledging this, I accept complete responsibility for the minor children and myself in my charge and visit the property and equipment and engage in activities or events at my own risk.
I will abide by the rules and accept these rental conditions:
*The property I rent will be returned in the same condition in which it was rented and I will be responsible for all damage and/or loss that occurs during my rental period.
* I agree to hold harmless and to indemnify the Owner of the Rental Property against all loss, damage, expense and penalty on account of personal injury or property damage to the rental dwellers, the undersigned or to any minor child or children in the charge of the undersigned, howsoever rising, whether by act or acts or failure to act of the employees, owners or animals of the said company or property owners or not.
*I acknowledge receipt of the property in good order and condition (if found otherwise per my arrival I will contact Owner immediately) and further agree that the Owner of the Rental Property shall not be liable for consequential damages of any kind or nature from whatever cause arising, whether property or equipment is loaned or rented.
*I enter into agreement freely with the Owner of the Rental Property at my own risk, acknowledging the risks inherent in indoor and outdoor activities and assume any and all responsibility for the minor children and myself in my charge.
*All parties agree to and will comply with Federal, State and County pollution laws and any other applicable laws and regulations.
