Trip/Storm/Any Reason Insurance:
We are encouraging all guests to purchase ‘For Any Reason’ trip insurance at time of booking for unforeseen travel issues. This includes fear of travel or simply changing your mind.
Check in / check out:
This property requires a 7 night minimum stay.
CHECK IN TIME: 4:00 PM EST CHECK OUT TIME: 10:00 AM.
Unless prior written permission is granted by the owner, late checkouts will entail a $1.00 + 12% tax charge for each minute.
Housekeeping/Laundry: While linens and bath towels are included in the unit at the beginning of your stay, daily housekeeping service is not included in the rental rate. Follow any posted signs or appliance instructions. Please leave the linens on the bed – wash the beach towels before you leave.
Guest Restrictions & Maximum Occupancy: At least ONE GUEST must be 25 years of age to rent this home and provide proof of age if requested.
The home has a maximum occupancy of six (6) guests (limited to 5 adults >18 years). GUESTS who exceed the occupancy limit and/ or falsify occupancy information at the time of reservation are subject to eviction and will be charged with US$500.00 per day per person + 12% tax.

Rental Rate: Cost per night for specified rental dates. Nightly rates will not be adjusted after booking is confirmed as prices are subject to change without notice. After booking, if you wish to adjust dates within the same week or extend your stay, it will be based on current availability and nightly rates only.
Cleaning Fee: A cleaning fee is required for each stay and is not dependent on the number of nights booked or the number of guests. This fee is inclusive of standard cleaning and linen service following rental of the unit. This does not include daily housekeeping service. For stays longer than 21 days, additional mid-stay cleans will be required and charged every 21 days. Guest must accept and make the house available for every 2 weeks house damage checks.
Taxes: Florida sales (7%) and Manatee County (5%) taxes are collected (12% total) on all rental rates, cleaning fee, damage waiver fee. In the event of any tax law changes applicable to the reservation dates, the guest is responsible to pay the monetary difference that may occur. These changes can affect reservations already paid in full and the guest is responsible to pay the additional fees should they occur.
Please check upon arrival that the pool alarm is working and notify OWNER immediately if it is not working properly. It is installed at the door to the pool area to avoid little children having access to the pool without an adult supervising them. If GUEST takes batteries out or any other manipulation causing the pool alarms not to work GUEST will be liable for any injuries or damages that happen to them or their children or any other third party. OWNER will not be liable or responsible for any damage or injuries.
Checkout procedures: Any furniture (including beach furniture) moved during your stay must be placed in the original position. Please turn the A/C thermostat to 80 degrees when departing. Upon checking out, please be sure that all windows and doors are closed and locked. All trash must be placed in bags and taken outside to trash bins. All dirty dishes must be washed and put away. (Final day dishes should be run through the dishwasher). All linens can stay on beds.
We will not be liable or responsible for personal items left behind, lost, or stolen.
If the GUEST leaves an item after checking out and wishes to have it returned, inform the OWNER by email as soon as possible and the OWNER will try to arrange a shipment. OWNER will inform GUEST of the shipping cost and with Guest’s approval, deduct from GUEST’S deposit refund to cover the expense.
Indemnification:
The Guest agrees to indemnify and hold the owner NOT responsible for any accidents, injuries, illness, or loss of personal belongings that occurs to any guests or visitors of guest while on the premises or its facilities. By accepting this reservation, it is agreed that all guests are expressly assuming the risk of any harm arising from their use of the premises or others whom they invite to the premise. Guest agrees not to give code or key or access to the property to unregistered guests or visitors.
OWNER supplies games and activities for our guests however some games have small pieces or parts and are not suitable for young children, i.e. toddlers and infants, who may put things in their mouths. Do not allow young children to play unsupervised with games.
Owner shall not be liable to guests or to any party for any type of issued violations, including but not limited to: traffic tickets, noise complaints, turtle ordinance violations, etc. The sole responsibility lies on the Registered Guest.
Successors & Assigns:
Guest shall not assign his or her rights under this agreement, or sublet the property, in whole or part, to another party without the prior written consent of the owner. This guarantees cancellation of reservation or immediate eviction from the property. The owner retains the right to assign his or her rights under this agreement to a third party without further notice. This may lead to a cancellation of the booking according to the cancellation policy above.
Construction: In the event of neighboring construction in any street on the Island or on the beach, the Owner shall not be held responsible to provide any type of advance notification to incoming guests. No refund for such kind of reasons. Property views are subject to change due to construction that may occur anywhere on the island.
Smoking:
Smoking or vaping of any kind is not permitted inside or outside or near any open windows or doors. This includes cigars, e-cigarettes, etc. Do not leave ashtrays or cigarette butts outside on the streets.
Noise:
Guests should not create excessive noise at a level that disturbs neighbors; Code-enforced neighborhood quiet hours are from 10:00p.m. – 7:00am. Police can issue tickets and fines and will notify us of violations in neighborhood areas. Any repeated reported violations of this can result in eviction.
Parking:
Designated parking is limited per house. Vehicles are to be parked in designated areas only. Parking on the road is NOT permitted. Any illegally parked cars are subject to towing; applicable fines/towing fees are the sole responsibility of the vehicle owner.
Property:
Keep the property and all furnishings in good order. Doors and windows should be closed and locked when the property is not occupied. Do not remove any items, including bath towels and linens (excluding beach chairs, toys, umbrellas, and beach towels), or throw any items away without first notifying the owner. In the event of anything broken or damaged, please notify the manager immediately.
Fire Safety:
Only use appliances for their intended uses. Do not leave grills or stoves/ovens unattended. A fire extinguisher is located downstairs next to the entry door, in the garage, and upstairs in the hallway. Do not tamper with smoke detectors. Hearing-impaired smoke detectors are available upon request. Please notify the owner if you require one during your stay. Familiarize yourself and your guests with the emergency exits map provided on the wall behind the entry door. Always have an extinguisher handy and do not allow excessive flames to form when using the fire pit. The fire pit is not to be used at night during turtle season (May 1-Oct 31) or at any time during an active county burn ban.
Garbage:
Any garbage must be stowed in the proper garbage or recycling receptacle, located in front of the house. The City of Holmes Beach has strict regulations regarding trash. Trash pick up is each Friday and Monday – Recycling bins are on Tuesday. Do not pull bins onto streets on any other day.
Pests:
Florida has lots of bugs. Please be advised the building and grounds are routinely treated for pests. While every effort is made to use non-toxic treatments, please use caution with children who crawl on ground. Follow recommendations regarding mosquito bite prevention.
Grills/Propane:
A Grill and one propane tank are provided as a courtesy for use by all guests. We do our best to provide an extra filled tank. Please notify me if you swap an extra tank out so that I can replace it. In the event all propane tanks are empty, please refill the tank and provide a copy of the receipt to be reimbursed.
Pool/Spa Area:
Rules
1. Pool fence gates to pool deck area need to remain closed and locked when not in use.
2. Please shower and remove all sand prior to entering pool.
3. No glass is permitted in pool deck area.
4. Children under 12 need adult supervision at all times.
5. All non-toilet trained children must wear swim diapers at all times.
6. No pets, food, diving, or horseplay are allowed in pool.
7. Please be advised that pool area is slippery when wet so we discourage running in pool area.
8. Do not walk on rocks or in planting beds.
9. Swim and walk in pool area at your own risk.
10. The pool is heated for your comfort. Do not adjust settings on pool heater. Generally speaking, our winter months are considered from November through April. During these months we do our best to ensure that the pools are heated to a temperature of 82 degrees. However, please be aware that we do occasionally get cold spells that can send the temperatures down into the 30's for a few nights in a row. This will cause the pool water temperature to drop down to in the 70's and a pool pump will automatically shut down if the outside temperature gets too cold. The pump will then kick back on in the morning and begin re-heating of the pool back to 82, which may take several days depending on the severity of the cold spell. Ultimately, these situations are beyond our control.
Due to the Island's strict 10pm noise ordinance, the pool heaters will not run overnight.
We closely monitor the pool. Please allow weekly pool maintenance staff to perform duties while on site.
Pool alarms are provided for young children’s safety, we cannot be held responsible for any injury that occurs if they are tampered with or removed.
When using the spa or hot tub, remember there is a certain health risk associated with this facility. SPA: Use at your own risk. DO NOT PUT SOAP OR BUBBLES IN SPA. A SPA is not a hot tub, it is simply a section of the heated pool that provides warm bubbles for comfort and relaxation but will not get hot (above 100 F). If you want to use the SPA you have to push the "SPA PARTY" Button and wait 40 to 45 Minutes until it is warm.
Pool water temperature: During the winter (Nov – March) we try to keep the water temperature at 84 degrees. But it might happen that it drops below 84 because the night temperatures may drop below 50.
City Ordinances:
Guests are responsible for familiarizing themselves and abiding by rules and instructions set forth in the ordinances in the city in which they are renting or visiting.
Emergency Exits:
Behind the entry door there is a floorplan showing the location of the emergency exits. Please familiarize yourself with it.
Failure of Equipment/Condition:
In the event of failure of equipment to work, please notify us first so repairs can be made as quickly as possible. There will be no refund of all or part of the rental amount for any failure of any of the equipment to work – including internet connection. Maintenance, repair and/or inspection of the unit may occur during your stay. In this case our handyman, contractors or service providers might require access to the unit, with notice or in case of an emergency without formal notice. All this is no reason for any kind of refund or complain.
Turtle Season:
Lights are not allowed on or near the beach after dusk during turtle season (May 1-Oct 31). Please do not use tiki torches, fire, string lights, spotlights, flashlights or any outdoor lighting on or near beach after dusk during this season.
Porch/Balcony:
Supervise children at all times. Do not hang items or clothes from railings. Keep door to porch and balcony closed at all times. Do not stand on or lean on railings. Keep doors closed when not in use.
Baby Supplies, Bike, Water Sport & Beach Equipment User Agreement and Waiver Form:
In connection with the usage of beach supplies , baby supplies or other equipment from „SUNNYSIDE“ the GUEST understands, acknowledges and agrees that the use of the any equipment by him/herself or any other person, including specifically any minor child authorized by GUEST to use such beach / swim / game / pool - equipment constitutes an acceptance of the following;
That there is a risk of accident and/or injury in the operation and or use of any equipment from our property at 207 64th Street, Holmes Beach. Usage is at your own risk.
That all equipment will be inspected by GUEST before being used by GUEST or GUEST’S representative. If any equipment is unsatisfactory
DO NOT USE BROKEN OR FAULTY EQUIPMENT.
That all equipment must be operated and/or used in accordance with applicable municipal laws and the laws of the State of Florida
Please ask your Doctor if you have any health problems before using bicycles or any other equipment.
That the GUEST hereby releases, waives, discharges, holds harmless house owner for any other damages and/or injuries sustained in connection with the operation, use, misuse, of beach / swim / pool / game / technical - equipment. OWNER will not be held liable or responsible for injuries as a result of use, misuse or lack of proper supervision and does not warrant or guarantee the fitness of the equipment for intended use. Failure to supervise can result in injury.
I HAVE READ AND UNDERSTAND THIS AGREEMENT AND I AM AWARE THAT BY ACCEPTING THIS AGREEMENT I MAY BE WAIVING CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE. I DO SO FREELY AND VOLUNTARILY AS PART OF THIS RENTAL AGREEMENT TERMS AND CONDITIONS WITHOUT ANY INDUCEMENT.

Term of the Lease:
The lease begins at 4:00 p.m. on the “Check-in Day” and ends at 10:00 a.m. on the “Check-out Day” listed on Booking Confirmation and will be strictly enforced in order to allow time for housekeeping to clean property adequately between guests. Early check in and late check outs are only available with prior written approval from owner and will not be guaranteed. It is the responsibility of the guest to ensure accuracy of dates in this contract. Once booking has been confirmed, dates cannot be changed or adjusted unless owner agrees to do so.

NO REFUNDS will be given from monies which have been paid or for providing lodging for any day(s) the authorities order a mandatory evacuation order for in a "Tropical Storm/Hurricane Warning”. Any unused portion of rent from a guest currently staying, any unused portion of rent from a guest that is scheduled to arrive and wants to shorten the stay or to come in after the “Warning” is lifted and any advance rents collected for a reservation that is scheduled to arrive during the “Warning” period. Any unused portion of rent from a guest who had to leave the house due to an evacuation mandate or due to their own decision to leave the house and want to come back after the weather-related situation has improved and guest cannot check in anymore or does not like to check in anymore because the house / pool / landscape was damaged or internet or power services are interrupted.
There may be other circumstances besides weather related incidents in which the property is not available for GUEST’S check in anymore and the OWNER decides to cancel. Then OWNER will refund 100% of all monies paid. OR 100% voucher for future travel dates. If anything happens after GUEST‘S check in the unused portion of rent will be refunded.
This will be the full extent of our liability to you in such circumstances and OWNER will not be responsible for any other costs connected with any such cancellation, howsoever arising.
GUEST must cancel by 11:59pm on the cut-off day before check-in to receive a refund. All times are specific to property's time zone. If GUEST doesn’t pay according to the payment plan, booking will be cancelled and GUEST will forfeit what they have already paid.
